Terms and Conditions for InvestorDuel

These Terms of Service ("Terms") govern your use of the InvestorDuel website at https://investorduel.to (the "Website") and the services provided through InvestorDuel (the "Service") by Lightning Strategy Limited LLC, a limited liability company incorporated in the State of Wyoming, United States of America ("we," "us," or "our"). InvestorDuel is a stock market game that allows users to compete against each other by building virtual stock portfolios with virtual cash. By using our Website and Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. User Accounts
To access certain features, you must create an account by providing accurate information, including your name and email. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at lukas@investorduel.to of any unauthorized use.

3. Subscriptions and Payments
The Service offers free access with limited features and paid subscription plans ("Paid Plans") for enhanced features, such as more players per competition, additional active competitions, and higher portfolio limits.
•	By purchasing a Paid Plan, you gain access to and use of the Service within the limits of that plan.
•	You may use the Service in a normal, intended manner.
•	Payments are processed through third-party providers. You authorize recurring charges for your subscription.
•	You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the end of the current billing period. Downgrades (including to a lower Paid Plan or to the free plan) will apply only after the current billing period ends.
•	Upon a downgrade becoming effective, any existing competitions that exceed the limits of the new plan (e.g., competitions with too many players or too many active competitions) will be deleted. We are not responsible for any loss of access to such content resulting from a downgrade.
•	No refunds are provided except as required by law.

4. User Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
•	Abuse the Service, including automated excessive use or attempts to manipulate competitions.
•	Violate any applicable laws or regulations.
•	Interfere with the Service or other users' enjoyment.
We reserve the right to suspend or terminate your access to the Service at any time if we suspect abuse or violation of these Terms, without prior notice or liability.

5. Virtual Trading and No Financial Advice
The Service is a simulation game using virtual cash and real-time market data for educational and entertainment purposes only. It does not involve real investments, and performance in the game does not guarantee real-world results. The Service does not provide financial, investment, or trading advice. The financial data provided in the Service is sourced from third parties and does not guarantee to be correct, complete, or up-to-date. Consult qualified professionals for real investment decisions.

6. Intellectual Property
The Service, including all content, features, and functionality, is owned by Lightning Strategy Limited LLC or its licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

7. Data Collection and Privacy
We collect personal information such as your name, email, and payment information. We also collect non-personal data, including web cookies and usage data related to the Service. 8. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any direct or indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" without warranties of any kind, express or implied.

9. Discontinuation of Service
We reserve the right, at our sole discretion, to discontinue the Service (or any part thereof) at any time, with or without notice. This may include permanently shutting down the Website and making the Service unavailable. Upon discontinuation, all accounts, data, competitions, and access will terminate, and we will have no obligation to maintain or provide access to any user content or data. If the Service is discontinued, any active subscriptions will be canceled, and we may provide prorated refunds at our discretion, but no refunds are guaranteed except as required by law.

10. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your access as described elsewhere in these Terms.

11. Changes to These Terms
We may update these Terms from time to time. The most current version will always be posted on the Website. For significant changes, we may notify you by email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to conflict of laws principles.
